1. Acceptance of these Terms

By accessing or using Tabulizer.com, creating an account, using an online wizard, purchasing a membership, downloading software, using support services, or otherwise using any Tabulizer service, you agree to these Terms of Use.

If you use Tabulizer on behalf of a company, organisation, school, public authority, client, or other legal entity, you confirm that you have authority to bind that entity to these Terms.

If you do not agree to these Terms, you must not use Tabulizer.com, the online wizards, downloads, memberships, support services, or related software.

2. Service provider

Tabulizer.com is operated by Alterora OÜ.

In these Terms, “Tabulizer”, “we”, “us”, and “our” refer to Alterora OÜ and the Tabulizer.com website, services, software, online wizards, rulesets, downloads, documentation, support services, and related products.

3. Services provided

Tabulizer provides software and online services that help users create, style, transform, and render tables and other data-driven content for Joomla and WordPress websites.

The services may include:

• Tabulizer software for Joomla and WordPress;
• online wizards for creating tables, charts, D3 visualizations, galleries, contact forms, calculators, calendars, timelines, and pricing tables;
• ruleset creation tools and downloadable ruleset files;
• documentation, tutorials, feature pages, examples, and demo pages;
• membership areas and software downloads;
• support services, where included with your membership or purchase;
• software updates, where available and applicable.

We may change, improve, replace, remove, suspend, or discontinue parts of the website or services at any time, subject to applicable law.

4. Registration, user accounts, and passwords

Some Tabulizer services may require registration or an account. Your account may also be created automatically when you purchase a membership or download product.

You agree to provide accurate, current, and complete information during registration, checkout, support requests, and account use. You must keep this information up to date.

Username

You must not choose a username that is unlawful, misleading, offensive, vulgar, impersonates another person, violates third-party rights, or is otherwise inappropriate. We may reject, rename, suspend, or remove usernames that we consider inappropriate.

Password and account security

You are responsible for maintaining the confidentiality of your password and account information. You are responsible for all activity that occurs under your account.

You agree to notify us immediately at info@alterora.com if you become aware of unauthorised access, a password leak, account misuse, or any other security issue affecting your account.

5. Software license and permitted use

When you purchase, download, or access Tabulizer software, you receive a limited, non-exclusive, non-transferable license to use the software according to these Terms and any license terms, documentation, membership terms, or product-specific conditions provided with the software.

Unless expressly permitted in writing, you must not:

• resell, redistribute, sublicense, rent, lease, or make Tabulizer available as a competing product or service;
• remove copyright notices, license notices, or attribution information from the software;
• use Tabulizer to create unlawful, infringing, harmful, abusive, or misleading content;
• attempt to bypass license controls, membership restrictions, download limits, or access controls;
• use the software in a way that violates applicable laws or third-party rights.

Open-source third-party libraries included with or used by Tabulizer may be subject to their own license terms. Those terms remain applicable to the relevant third-party components.

6. Online wizards and generated output

Tabulizer may provide online wizards that allow users to create rulesets, configuration files, HTML output, sample data, charts, visualizations, forms, calculators, pricing tables, calendars, timelines, galleries, or other generated content.

You are responsible for reviewing and testing any generated output before using it on a production website. Generated output may need adjustment depending on your Joomla or WordPress version, theme, template, plugins, modules, extensions, hosting environment, server configuration, browser support, accessibility requirements, and legal obligations.

7. Purchases, memberships, and payments

Tabulizer products, memberships, downloads, updates, support access, or related services may be offered as paid products.

Prices, membership durations, included features, support periods, update access, download rights, and product availability may be displayed on the website or during checkout. We may change prices and product offerings from time to time. Changes do not normally affect purchases already completed, unless otherwise stated or required by law.

Payments are processed by 2Checkout / Verifone or related payment-processing services. Payment processors may collect billing details, transaction information, tax information, fraud-prevention data, and payment details according to their own terms and privacy policies.

You agree to provide accurate billing and payment information. You are responsible for any taxes, fees, duties, bank charges, currency conversion charges, or similar amounts that may apply to your purchase, unless otherwise stated during checkout.

8. Consumer rights and digital content

If you are a consumer located in the European Union or another jurisdiction with mandatory consumer protection laws, you may have statutory rights that cannot be excluded by these Terms. Nothing in these Terms is intended to limit rights that cannot be limited under applicable law.

For online purchases, consumers in the EU may generally have a right to withdraw from a distance contract within 14 days. However, special rules may apply to digital content, software downloads, memberships, access to online services, or services that begin before the end of the withdrawal period with the consumer’s consent.

Where required, checkout or payment pages may ask you to confirm that you want access to digital content or services to begin immediately and acknowledge the effect this may have on your right of withdrawal.

9. Refunds and cancellations

Refunds may be available where required by applicable law, where we have expressly offered a refund policy for a specific product, or where we decide at our discretion to provide a refund.

Because Tabulizer products may include digital downloads, membership access, software access, online services, rulesets, support resources, and other digital content, refund eligibility may depend on the product type, access already provided, download status, service usage, applicable consumer law, and the terms shown during checkout.

We may refuse a refund where:

• the refund request is outside the applicable refund period;
• the product was downloaded or accessed and the right of withdrawal was lawfully waived or lost;
• the user violated these Terms;
• the request is abusive, fraudulent, or made in bad faith;
• the refund is not required by applicable law or our published refund policy.

10. Updates, compatibility, and support

Where included with your purchase or membership, we may provide software updates, documentation, bug fixes, support replies, or other assistance. The level and duration of support may depend on your membership type or product terms.

We cannot guarantee compatibility with every Joomla version, WordPress version, PHP version, database engine, hosting provider, theme, template, plugin, module, extension, browser, or custom website configuration.

You are responsible for:

• maintaining backups before installing, updating, or modifying software;
• testing Tabulizer on a staging or development website before production deployment;
• ensuring your server environment meets the technical requirements;
• keeping Joomla, WordPress, PHP, extensions, plugins, themes, and templates updated and secure;
• checking that generated output meets your accessibility, legal, design, and performance requirements.

11. User content, data, and uploaded materials

You may provide data, text, CSV content, HTML, images, configuration settings, files, database connection details, ruleset data, form content, support messages, or other materials when using Tabulizer services or online wizards.

You retain your rights in your own content and data. You grant us a limited right to process, store, transmit, display, and use that content only as needed to provide the services, operate the website, generate requested output, provide support, maintain security, and comply with law.

You are responsible for ensuring that any content or data you provide:

• is accurate and lawful;
• does not infringe third-party intellectual property rights;
• does not contain malware, harmful code, or unlawful material;
• does not include personal data unless you have a lawful basis to provide it;
• can lawfully be processed by Tabulizer for the purpose requested.

We do not claim ownership of your website data, table data, wizard input, or generated project content.

12. Acceptable use

You agree to use Tabulizer.com, the online wizards, downloads, support services, and software only for lawful purposes and in accordance with these Terms.

You must not:

• use the services for unlawful, fraudulent, misleading, harmful, abusive, or malicious purposes;
• attempt to gain unauthorised access to accounts, systems, servers, databases, or networks;
• interfere with or disrupt the operation, security, or performance of Tabulizer.com;
• use automated scraping, crawling, harvesting, or extraction tools without our prior written permission;
• copy or collect email addresses, user details, pricing information, documentation, or website content for unsolicited marketing;
• upload or transmit viruses, malware, Trojan horses, worms, harmful scripts, or destructive code;
• use the services to infringe copyright, trademarks, trade secrets, privacy rights, publicity rights, or other third-party rights;
• use the services to generate or distribute spam, phishing content, scams, illegal goods, or harmful content;
• attempt to reverse engineer, bypass, overload, probe, scan, or test the vulnerability of systems without authorisation;
• misrepresent your identity, affiliation, authority, account ownership, or payment details;
• resell, mirror, clone, or make available the services in a way that competes with Tabulizer without written permission.

We may suspend or terminate access if we reasonably believe these Terms have been violated.

13. Intellectual property

Tabulizer.com, the Tabulizer name, logos, software, source code, compiled code, ruleset formats, wizard interfaces, website design, documentation, tutorials, examples, text, graphics, icons, demos, and related materials are owned by or licensed to Alterora OÜ, except where otherwise stated.

You must not copy, reproduce, modify, distribute, publish, sell, license, create derivative works from, or otherwise exploit Tabulizer materials except as expressly permitted by these Terms, a product license, applicable law, or written permission from us.

Third-party trademarks, product names, CMS names, library names, and platform names remain the property of their respective owners. References to Joomla, WordPress, PHP, DataTables, D3.js, Google, MailerLite, 2Checkout, Verifone, or other third-party services do not imply endorsement unless expressly stated.

14. Service availability and changes

We aim to keep Tabulizer.com and related services available, but we do not guarantee uninterrupted or error-free access. The website or services may be unavailable due to maintenance, updates, hosting issues, security events, third-party provider issues, technical failures, or circumstances beyond our control.

We may modify, suspend, replace, limit, or discontinue any part of the website, online wizards, downloads, documentation, support services, or product offerings at any time.

Where a change materially affects a paid service, we will try to provide reasonable notice where practical and where required by applicable law.

15. Disclaimers

Tabulizer.com, the online wizards, downloads, documentation, generated output, examples, demos, and support materials are provided on an “as is” and “as available” basis, except where warranties are required by applicable law.

To the maximum extent permitted by law, we disclaim all express or implied warranties, including warranties of merchantability, fitness for a particular purpose, non-infringement, accuracy, availability, compatibility, security, uninterrupted operation, and error-free performance.

We do not guarantee that:

• Tabulizer will meet every requirement of your project;
• the software will be compatible with every hosting environment, CMS configuration, theme, template, plugin, extension, or browser;
• generated output will be legally, technically, or commercially suitable for your specific use case;
• the website or services will be uninterrupted, secure, or free from errors;
• all bugs or compatibility issues will be fixed within a specific timeframe;
• documentation, examples, demos, or support content will be complete or free from mistakes.

16. Limitation of liability

To the maximum extent permitted by applicable law, Alterora OÜ, its owners, directors, employees, contractors, suppliers, licensors, and service providers will not be liable for indirect, incidental, consequential, special, exemplary, punitive, or business losses, including loss of profits, revenue, goodwill, data, business opportunity, website traffic, search rankings, or expected savings.

We are not responsible for:

• losses caused by your installation, configuration, modification, or use of Tabulizer;
• website downtime, data loss, or compatibility issues caused by hosting environments, CMS updates, third-party extensions, plugins, modules, themes, templates, or custom code;
• errors in source data, imported data, database queries, generated output, rulesets, or user-created configurations;
• third-party payment processor issues, email provider issues, analytics provider issues, hosting provider issues, or other third-party service failures;
• legal, accessibility, tax, accounting, consumer, or regulatory compliance decisions made by you based on generated content or website output.

Where liability cannot be excluded, our liability will be limited to the maximum extent permitted by applicable law. For paid services, and unless prohibited by law, our aggregate liability will not exceed the amount you paid to us for the specific product or service giving rise to the claim during the six months before the claim arose.

17. Indemnification

You agree to defend, indemnify, and hold harmless Alterora OÜ, its owners, directors, employees, contractors, suppliers, licensors, and service providers from and against claims, liabilities, damages, losses, costs, and expenses arising from or related to:

• your use or misuse of Tabulizer.com, the online wizards, software, downloads, or services;
• your violation of these Terms;
• your violation of applicable laws or regulations;
• your content, data, database queries, uploaded materials, generated output, or website implementation;
• your infringement or alleged infringement of third-party rights;
• your failure to maintain backups, test updates, secure your website, or comply with legal requirements.

We reserve the right to assume the exclusive defence and control of any matter subject to indemnification, and you agree to cooperate with us in defending such claims.

18. Suspension and termination

We may suspend or terminate your account, membership, download access, support access, or use of the services if:

• you breach these Terms;
• you fail to pay applicable fees;
• your payment is reversed, disputed, fraudulent, or unauthorised;
• your account is used for unlawful, abusive, or harmful activity;
• we are required to do so by law or by a payment, hosting, or infrastructure provider;
• continued access would create security, legal, operational, or reputational risk.

After termination, your right to access paid services, downloads, support, or account features may end. We may retain certain information where required for legal, tax, accounting, security, fraud-prevention, or legitimate business purposes, as described in our Privacy Policy.

19. Governing law and jurisdiction

These Terms are governed by the laws of Estonia, unless mandatory consumer protection laws in your country provide otherwise.

Where legally permitted, disputes relating to these Terms, Tabulizer.com, or Tabulizer services will be subject to the courts of Estonia. If you are a consumer, you may also have rights under mandatory laws and courts of your country of residence.

20. Notices and electronic communications

You agree that we may send notices, disclosures, invoices, order confirmations, account messages, support replies, policy updates, and other communications electronically, including by email, website notice, account message, or other electronic method.

Electronic communications are considered received when sent or made available, unless applicable law requires otherwise.

21. Assignment

You may not assign or transfer your rights or obligations under these Terms without our prior written consent.

We may assign or transfer our rights and obligations in connection with a merger, acquisition, sale of assets, reorganisation, change of control, or transfer of the Tabulizer business, provided this is done in accordance with applicable law.

22. Severability

If any part of these Terms is found to be invalid, unlawful, or unenforceable, the remaining parts will continue to apply. The invalid or unenforceable provision will be interpreted or replaced in a way that most closely reflects the original purpose, to the extent permitted by law.
